Essential Documents for Your Property Purchase in Portugal

Before embarking on your property purchase voyage, ensure you have all the necessary documents on board. This checklist serves as your handy treasure map, guiding you through the required paperwork for a successful transaction.

Documents Required by You (Buyer):

Bilhete de identidade/passaporte (Passport or Portuguese ID): Provide your lawyer with a copy of your passport or ID card for each individual or company involved in the purchase.

Número de contribuinte (NIF) (Fiscal Number): Anyone buying property in Portugal needs a NIF. Obtain it from the "FINANÇAS" (Tax Department).

Documents Required by the Seller:

Caderneta predial (Tax/Financial Registration of the Property): This document, issued by "FINANÇAS", details the property's financial registration and associated taxes. For rural properties, a "Caderneta Rústica" is also required.

Registo Predial (Property Registration Certificate): This document, obtainable from the "Conservatoria do Registo Predial" (Land Registry Office), verifies ownership and reveals any outstanding loans/mortgages and property details like size and construction area.

Licença de utilização ou construção (Habitation/Construction License): Required for properties built after 1951, this document (issued by the "Câmara Municipal" or Town Hall) confirms the property's construction adheres to approved plans and is habitable. No property can be sold without it.

Energy Certificate: By law, all properties for sale must have an energy certificate.

Documents Completed During the Sale:

Contrato de Promessa de compra e venda (Promissory Contract of Purchase and Sale): This contract outlines the agreed-upon terms of the sale.

Escritura Pública (Final Deed of Conveyance): This final contract officially transfers ownership from seller(s) to buyer(s).
